Four Jingtian & Gongcheng Partners Reappointed as CIETAC Arbitrators

The China International Economic and Trade Arbitration Commission (CIETAC)has released the list of a new panel of arbitrators, effective as from May 1, 2017. Four Jingtian & Gongcheng attorneys renew their appointment as arbitrator. They are (by alphabetic order) DONG Chungang, PENG Xuejun, XU Sanqiao and ZHANG Hongjiu. In accordance with the Arbitration Law of the PRC and the Rules for Appointment of Arbitrators by CIETAC, arbitrators are reappointed every 3 years.

 

CIETAC is one of the major permanent arbitration institutions in the world. It independently and impartially resolves economic and trade disputes by means of arbitration. Since its founding in 1956, the Commission has concluded about 30,000 cases. CIETAC accepts foreign-related and international cases, as well as domestic ones. Its scope of accepting cases is not limited by the parties’ business nature or their nationality. CIETAC’s caseload has been one of the heaviest among the world’s leading arbitration institutions, involving parties from other countries and regions outside China Mainland. In recent years, the annual caseload has been above 1,000 on average. In accordance with the New York Convention, CIETAC awards are recognized and enforceable in 157 countries.

 

 

Dong Chungang Partner

Mr. Dong is partner at Jingtian & Gongcheng. Before joining the firm in 2006, he worked three years with China International Economic & Trade Arbitration Commission (CIETAC) as Case Manager.

Mr. Dong specializes in dispute resolution, liquidation, bankruptcy, and protection of intellectual property rights.

Mr. Dong has represented clients in hundreds of lawsuits before the Supreme People's Court of China, the Higher People’s Court of Beijing, CIETAC, Beijing Arbitration Commission, Shanghai Arbitration Commission, ICC, HKIAC, SIAC, etc., which involved a variety of substantive areas such as trade, investment, real estate, finance, energy, technology, building materials and logistics. He has also advised clients or acted as PRC legal expert for litigation and arbitration heard in the US, Singapore and Hong Kong.

Mr. Dong has extensive experience in advising clients on liquidation and bankruptcy under PRC law, as well as protecting intellectual property rights by administrative proceedings or litigation.

Chambers & Partners, Legal 500, Asia Law & Practice, LegalBand and other renowned legal publishers rank Mr. Dong as a leading commercial litigator in China for consecutive years. Mr. Dong was shortlisted for PRC Dispute Resolution Lawyer of the Year and/or PRC Arbitration Lawyer of the Year by China Law & Practice respectively in 2013, 2015 and 2016, and he was recently identified by China Business Law Journal as one of China’s top 100 lawyers.

Mr. Dong holds a Bachelor of Arts (English Language and Law) and a Master of Laws from China University of Political Science and Law, and a Master of Laws (LLM in American Law) from Boston University.

Mr. Dong is qualified to practice in China and New York State of the United States.

Mr. Dong is an arbitrator of CIETAC, who hears around ten cases each year at CIETAC. He is also a mediator of CCPIT/CCOIC Mediation Center, arbitrator of Chongqing Arbitration Commission, master student supervisor of China University of Political Science and Law, one of the 16 dispute resolution panelists of R&D-Based Pharmaceutical Association Committee (RDPAC), and member of the Arbitration Law Committee of Beijing Lawyers Association.

Mr. Dong has published dozens of legal articles in domestic and overseas publications such as Collected Thesis of Private International Law, Arbitration and Law, Chinese Arbitration and Judicature, Arbitration in Beijing, Asian Legal Business and The Lawyer. Mr. Dong is the author of the China Chapter of Global Legal Group’s International Comparative Legal Guide: International Arbitration (2009), and contributor for World Bank’s website (Investing Across Borders, 2012).

Mr. Dong was invited to give speeches on international conferences including the 5th Asia Pacific Regional Arbitration Group Conference (2013), the 14th Cross-Strait Symposium on Economic and Trade Arbitration (2014), and the Africa/Latin America Investment and Dispute Resolution Seminars (2016). Mr. Dong also sat in the Host Committee of the IBA Arbitration Day Conference (2016).

Peng Xuejun Partner

Mr. Xuejun Peng is a founding partner of Jingtian & Gongcheng. He graduated from Peking University Law School with LL.M. (1996) and LL.B. (1986). Before founding the firm in 1992, he was an officer in the Civil Aviation Administration of China from 1986 to 1989 and an in-house counsel of CITIC from 1989 to 1992. He was once seconded as a visiting lawyer to Herbert Smith LLP, London.

Mr. Peng specializes in dispute resolution, particularly concerning Investment, Corporate, M&A, Banking & Finance, Securities, International Procurement and Technology Transfer, IP, Aviation and International Trade. He is the founder of the celebrated dispute resolution practice of the firm.

Mr. Peng has represented domestic and foreign clients in hundreds of arbitration and litigation proceedings, including many multiple-million and high-profile (and even bet-the-company) cases. Mr. Peng demonstrated sophisticated strategy planning and skilled advocacy in these cases, which are highly appreciated by clients from both public and private sectors.

In addition to his highly commended counsel work, Mr. Peng is also a senior arbitrator, of CIETAC. He has acted as arbitrator, often as chairman, in more than a hundred of domestic and international arbitrations.

Mr. Peng’s expertise in litigation and arbitration has been highly recognized by the market and the industry for a long time. Mr. Peng is a guest researcher at the Corporation and Company Law Research Centre of Peking University, and a joint-advisor in the Juris Master program of Tsinghua University Law School, and an executive director of the China Association of Business Law. He also served as an independent director in several listed companies.

Xu Sanqiao Partner

Sanqiao Xu graduated from Law School of Peking University with LL.B. degree in 1986 and Law School of People’s University of China with LL.M. degree in 1989.   In the academic year of 1999-2000, Mr. Xu conducted research as a visiting scholar at the Harvard Law School in USA.

Mr. Xu worked at South China Sub-commission, CIETAC during the period of July 1989 to October 2006, with positions from staff to Deputy Secretary General of the Secretariat.  In March 2007, Mr. Xu joined Jingtian & Gongcheng as a partner.

Mr. Xu specializes in arbitration and litigation, foreign investment, M & A.

In the field of arbitration, Mr. Xu is listed in the Panel of Arbitrators by CIETAC, HKIAC and Beijing Arbitration Commission.  Mr. Xu has arbitrated more than 200 foreign-related arbitration cases, which involve foreign investment, international trade, real estate, contracting, leasing, financing, etc.  Besides as an arbitrator, Mr. Xu also works as an attorney and has represented clients in other domestic and international arbitration cases.

In the field of lawsuits, Mr. Xu has handled cases involving contractual disputes, investment disputes and bankruptcy issues, etc.

In the fields of foreign direct investment and M & A, Mr. Xu has participated in many transnational M&A transactions within Mainland China on behalf of foreign investors.

Mr. Xu is co-author of “Case Studies of China International Economic and Trade Arbitration”, Vol. 1 and Vol. 2. He also often delivers speeches in international arbitration symposiums.

Mr. Xu obtained the PRC lawyer's qualification certificate and he is fluent in both Mandarin and English.

 

Zhang Hongjiu Partner

Hongjiu Zhang graduated from Faculty of Western Languages of Peking University with English major in 1980 and obtained LL.M. from Peking University School of Law in1983.

Mr. Zhang worked as lecturer for Peking University School of Law in 1983.  Then he worked as lawyer for CITIC from 1983 to 1996.  Mr. Zhang has been a partner of Jingtian & Gongcheng since 1996.

Mr. Zhang specializes in international finance, securities, cross boarder investment, corporate, M & A, and restructuring.

Mr. Zhang also has many titles for social activities, including Executive Council Member of All China Lawyers Association (“ACLA”); Vice Chair of Commission of International and WTO Legal Services of ACLA; Vice Chair of Finance & Securities Professional Commission of ACLA; Vice Chair of Foreign Affairs Committee of ACLA; Penal arbitrator of China International Economic and Trade Arbitration Commission (“CIETAC”); Director of China Mergers & Acquisitions Association (“CMAA”); Member of Chartered Institute of Arbitrations of UK.  He is also the independent board directors of several companies.
